Non compliance with the GDPR has three series of legal consequences : We’ve extensively heard of the administrative enforcement by national Data Protection Authorities. The third level is civil liability as set by the Article 82 GDPR.
In the midst of the holiday season, the French Data Protection Authority CNIL issued an administrative sanction to a French company operating in several countries in Europe offering payment solutions.
WhatsApp issued second-largest GDPR fine of €225 M : “The DPC gets about 10,000 complaints per year since 2018 – and this is the first major fine”.
Article 82 GDPR has created a right for compensation and edict the liability as a result of an infringement of this Regulation. So far, national courts have been rather reluctant or inconsistant at allowing compensation.
On July 16, 2021, the Luxembourg personal data protection authority finally ruled on our collective complaint filed by 10,000 people against Amazon in May 2018. This decision comes after three years of silence that made us fear the worst ( re-read our fears which, in the case of Amazon, are therefore now obsolete).
